Mr. Pekin has a prior history in San Benito County.  A search in court records located case number H031238, Mendiola v. Pekin, Court of Appeal of California, Sixth Appellate District where an appellate court reviewed an anti-SLAPP ruling involving Patrick Michael Pekin.  The plaintiff sued for defamation and other torts based on statements and litigation-related conduct.  The trial court struck most claims under anti-SLAPP, and the appellate court largely affirmed.  However, the appellate court reversed as to one claim, allowing an invasion of privacy claim based on alleged acquisition of bank records to proceed.  Voters may reasonably consider what this litigation history suggests about temperament, judgment, and respect for privacy.

I was just done wrong by Judge Pekin last week.  I've been at my job for 15 years.  Same amount of time I've been with my girlfriend.  I never asked her what she did all day long, or where she went, because I trusted her.  That was until this last March, I injured my knee while out riding my dirt bike, and was put on disability for 3 months.  I guess I cramped her style by being at home all day, every day.  She proceeds to leave and tell me she has a new man, and all that.  Fine, but then after a week and a half, she comes home and is just there.  The following day, the Sheriff's contact me to serve me with an emergency restraining order which forced me to move out of the house.  It was granted by Judge Pekin.

Well, I just had an opportunity to review the Mendocino County Superior Court Local Rules regarding emergency domestic violence restraining orders, and the burden of proof for granting them if it will result in a party being forced to move out of the home.  The rules say that the order shall not be granted, except upon a showing of FACTUAL proof of the violence.

In this case, I hadn't done anything to her.  She just wanted me out so she could bring her new guy in, and they could steal and sell my belongings, because I have some nice things.  Long story short, she totally lied and said I woke her up with a gun pointed to her head.  This never happened.  But my point is, where is the FACTUAL proof that is required pursuant to that rule?  She didn't have any camera or video footage proof that a gun was pulled on her;  there were no witnesses (again, because it never happened).  And then she also said I would lock the gate when I went to work and lock her on the property all day, and leave her without a phone or a vehicle.    There was no proof of that either, because that never happened.  She always had a key, and she could go any time she wanted to. 

But the point is, Judge Pekin DID NOT follow the rules that he is obligated to go by.  This resulted in a violation of my rights, an unjust emergency restraining order being placed on me, and now most of my personal belongings are probably gone and I'll never see them again.  And don't tell me Judge Pekin doesn't know the rules.  He just does whatever he wants, whether he is allowed to, or not.  I won't be voting for him, and I hope no one else does either.

Pekin has a pattern. And patterns are recognized by the judiciary committee.  We must ban together for a joint letter to the commission.

Yes, a notification to the Commission on Judicial Performance is in order.  You can write to them at 455 Golden Gate Ave., Suite # 14400, San Francisco, CA 94102.  They act like, "Oh, just because you're not happy with the judge's decision is not a reason for us to do anything."  That's what happened to me after I put in a HUGE complaint about Riemenschneider there in Mendocino County Superior Court.  I wrote them 11 handwritten pages of "Here's the law.  Here is what he did.  Here is the law, and here is what he did."  All I know is, one year later Riemenschneider retired, out of the clear blue sky.  I hope my complaint had something to do with it.  Yes, if you have been ROYALLY SCREWED by Pekin, like so many of us have, please write to the Commission and complain.  Check out their website at www.cjp.ca.gov.
